Adding Sustainability Risks and Factors to the MiFID II Suitability and Product Governance Requirements
by Maria Elena Salerno This essay proposes a critical analysis of the amendments that introduce sustainability factors and risks into the legal framework for suitability requirements and product governance regulation. It argues that the choice of the European legislator to favour a product-oriented model for sustainability-related financial instruments may undermine the duty of the financial intermediary to act in the best interest of the client.
